Terms & Conditions

These Terms & Conditions ("Terms") govern your use of theofficialwfhclub.com our membership community, and our online store (together, the "Services"), operated by The Official WFH Club ("we," "us," or "our"). By creating an account, purchasing a membership or product, or otherwise using the Services, you agree to these Terms and to our Privacy Policy.

Please note: Section 13 contains a binding arbitration clause and class-action waiver that affect how disputes between you and us are resolved.

1. Eligibility
You must be at least 18 years old (or the age of majority in your state) to create an account or make purchases. By using the Services, you represent that you meet this requirement and that the information you provide is accurate.

2. Accounts
You are responsible for your account credentials and all activity under your account. Keep your password confidential and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Membership & Billing

Subscription:Membership is billed on a recurring basis (monthly or annually, as selected at signup) andrenews automaticallyuntil cancelled.
Authorization:By subscribing, you authorize us and our payment processor to charge your payment method the applicable fee, plus any taxes, at the start of each billing period.
Price changes:We may change membership pricing with at least 30 days' notice. Changes take effect at your next renewal; if you do not agree, cancel before the renewal date.
Cancellation:You may cancel anytime through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you retain access until then.We do not provide refunds or credits for partial billing periods.
Failed payments:If a renewal charge fails, we may retry the charge and suspend access until payment is resolved.

4. Store Purchases, Shipping & Returns

Orders:All orders are subject to acceptance and availability. We may refuse or cancel any order, including for pricing errors or suspected fraud; if payment has been taken, we will refund it.
Pricing:Prices are shown in US dollars and exclude applicable taxes and shipping unless stated otherwise.
Shipping:Delivery estimates are not guarantees. Risk of loss passes to you upon our delivery to the carrier.
Returns:Physical products may be returned within30 days of deliveryin unused, resalable condition with proof of purchase. We refund the purchase price to your original payment method; return shipping is at your cost unless the item was defective or we shipped in error. Digital goods, gift cards, and final-sale items are non-returnable.

5. Community Rules
Our community works because members treat each other well. When participating, you agree not to:

Harass, threaten, demean, or discriminate against other members;
Post unlawful, defamatory, obscene, or knowingly false content;
Spam, advertise, or solicit other members without our permission;
Share other members' private information or content outside the community without their consent;
Impersonate any person or misrepresent your affiliation;
Upload malware or attempt to disrupt, scrape, or gain unauthorized access to the Services;
Use the Services to violate any applicable law.

We may remove content or suspend or terminate membership, without refund, for violations of these rules.

6. Your Content
You retain ownership of the content you post ("Member Content"). By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your Member Content as needed to operate and promote the Services. You represent that you have the rights to the content you post. We may remove Member Content that violates these Terms.

7. Our Intellectual Property
The Site, its design, text, graphics, logos, and all other content we provide (excluding Member Content) are owned by or licensed to The Official WFH Club and protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from them without our written permission. "The Official WFH Club" name and logo may not be used without our consent.

8. Third-Party Services
The Services may link to or integrate third-party websites and services (including payment processors). We are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure. Content shared in the community — including advice about remote work, careers, or wellness — is provided by members for general information and is not professional advice.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OFFICIAL WFH CLUB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) $100. Some states do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification
You agree to indemnify and hold harmless The Official WFH Club and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your Member Content, your use of the Services, or your violation of these Terms or applicable law.

12. Termination
You may stop using the Services and cancel your membership at any time. We may suspend or terminate your access at any time for violation of these Terms or to protect the Services or other members. Sections that by their nature should survive termination (including Sections 6, 7, and 9–13) will survive.

13. Dispute Resolution — Arbitration & Class-Action Waiver

Informal resolution first:Before filing a claim, you agree to contact us and give us 30 days to attempt to resolve the dispute informally.
Binding arbitration:Any dispute arising out of these Terms or the Services that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this provision.
Class-action waiver:Disputes must be brought on an individual basis. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
Exceptions:Either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property infringement.
Opt-out:You may opt out of this arbitration provision by emailing us within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.

14. Governing Law
These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 13.

15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the effective date above; for material changes, we will provide additional notice such as email or an in-Site notice. Continued use of the Services after changes take effect constitutes acceptance.

16. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a business transfer.
